Chairman Paul Shaw called the meeting of the Catawba Island Township Zoning Commission to order at 7:00 p.m. For the record, he identified the date was August 23, 2017.
He introduced himself, as well as the other Commission members, that included, Jordan Davenport, Vice Chairman, Stephen Lonneman, Ron Wiseman, Alternate Lewis Mindlin and Alternate Dr. Gregory Hart. Also introduced was Todd Bickley, Catawba Island Township Zoning Inspector and Board Secretary.
Chairman Shaw welcomed those in attendance. He stated the Zoning Commission appreciated their interest. He advised those in attendance that debates/talking amongst themselves would not be permitted. He asked that those in attendance sign the register. He requested that any person wishing to speak be recognized by the chairperson and identify themselves by name and address for the record. He asked that all cell phones be turned off. The Pledge of Allegiance was recited.
Mr. Shaw suggested the following agenda for the meeting.
1) Consider application #068039 from Dorothy J. Thompson to rezone a 1.10 acre parcel of land at 4967 Muggy Road from the “A” Residential Low Density District to the “R-1” Residential District.
2) Consider the text amendments, initiated by the Zoning Commission, to the Catawba Island Township Zoning Resolution modifying the definitions of dwelling; dwelling, multiple-family; and dwelling units.
3) The reading and approval of the July 26, 2017 meeting minutes.
4) Any old business.
5) Any new business.
Chairman Shaw asked if there were any additions or changes to the proposed agenda. There were none. Jordan Davenport made a motion to approve the proposed agenda for the meeting. Steve Lonneman seconded the motion. The motion passed.
Agenda Item 1 – Application #068039
Chairman Shaw noted that the first item of business was to consider application #068039 from Dorothy J. Thompson to rezone 1.10 acre parcel of land at 4967 Muggy Road from the “A” Residential Low Density District to the “R-1” Residential District. Ron Wiseman made a motion to consider Agenda Item #1. The motion was seconded by Dr. Gregory Hart. The motion passed.
At this time Steve Lonneman withdrew due to a personal conflict. Alternate Lewis Mindlin replaced Steve Lonneman for the review and consideration of application #068039.
Jordan Davenport read the legal description of the 1.01 acre parcel of land proposed to be rezoned.
Todd Bickley did not receive any correspondence.
Chairman Shaw read the recommendation letter from the Ottawa Regional Planning Commission, whom recommended approval of the rezoning request.
Tom Thompson represented the applicant and was willing to answer questions.
Jordan Davenport questioned if a right-of-way goes through the house parcel. Tom Thompson indicated that a right-of-way does not go through the parcel. Mr. Thompson noted that he and his brother are purchasing the business and separating the house from the business.
Tom Koutsourelis, at 1056 Lost Lake Drive, questioned the intent and whether the property will change. Mr. Thompson commented that other than normal property maintenance, the property will stay the same as it is now. If the business grows, an additional barn could be built. Mr. Koutsourelis indicated that he did not have any issues with the rezoning request.
Chairman Shaw closed the discussion to the floor.
Jordan Davenport made a motion to recommend approval of application #068039. The motion was seconded by Dr. Gregory Hart. Motion was approved.
Chairman Shaw noted that the Catawba Island Township Trustee meeting will be scheduled for September 12, 2017 at 7:30 P.M.
Agenda Item 2 – Text Amendments
Steve Lonnenman returned to the table.
Jordan Davenport made a motion to consider proposed text amendments, initiated by the Zoning Commission, to the Catawba Island Township Zoning Commission modifying the definitions of dwelling; dwelling, multiple-family; and dwelling units. The motion was seconded by Steve Lonneman. Motion passed.
There were no personal or professional conflicts.
Mr. Davenport read the Ottawa Regional Planning Commission letter.
Mr. Bickley noted that Walter Wehenkel had expressed a concern to Mark Messa, Director of the Planning Commission, that by approving the proposed text amendments, existing condominium developments that allow weekly rentals would become nonconforming uses. Mr. Lonneman commented that the township should not take away a right that they are now exercising. Matt Montowski noted that Come Sail Away is no longer a rental community and that the condominium at Gem Beach does not allow weekly rentals. Mr. Davenport noted that the modification clarifies what will be required for future developments. Ron Wiseman indicated that the right would not be taken away since it would be grandfathered. Dr. Gregory Hart commented that a right would not be taken away when the property owner is not now exercising it.
Discussion was closed to the floor.
Jordan Davenport made a motion to recommend to the trustees approval of the proposed text amendments with the word “more” added to the definition of multiple-family. Steve Lonneman seconded the motion. The motion passed with Steve Lonneman voting against the motion.
Agenda Item 3 – Approval of the July 26, 2017 Minutes
Steve Lonneman made a motion to approve the July 26, 2017 meeting minutes. Jordan Davenport seconded the motion. Motion passed.
Old Business
Lois McBurnie, 3993 NW Catawba Road, questioned if Jeff Jadwisiak received a parking letter. Mr. Bickley indicated that a letter was mailed August 23, 2017.
Ms. McBurnie questioned the zoning of Phil Whitt’s property. Mr. Bickley indicated that Mr. Whitt’s property is zoned “C-3”, which allows for parking areas. Ms. McBurnie questioned lighting. Mr. Bickley noted if lighting is provided, the lights will need to be directed away from the neighbors.
Jeff Williams questioned the other complainants. Mr. Bickley noted that Lisa Murphy and Lois McBurnie submitted a list of possible violators.
Mr. Lonneman questioned where the township goes from here. Mr. Montowski noted that the trustees are looking to the boat line for assistance. Mr. Lonneman asked if towing is an option. Mr. Montowski indicated that towing is an option.
Ms. McBurnie commented that shuttles are a nightmare and the night of the concert will be a logistical nightmare.
New Business
No new business to conduct.

Jordan Davenport moved to adjourn the meeting. His motion was seconded by Steve Lonneman. Motion passed. The meeting was adjourned at 8:02 p.m.
