Catawba Island Township Board of Zoning Appeals


July 8, 2009



The regular meeting of the Catawba Island Township Board of Zoning Appeals was called to order by Chairman Dale VanLerberghe at 7:30 in the conference room. Present were Jack DeVore, Dale VanLerberghe, Sandra Erwin and Pat Cerny. The meeting began with the Pledge of Allegiance followed by the introduction of Board members and a brief overview of the meeting proceedings.

CASE #543445 – Robert and Michelle Marshall – 2855 Sand Road – R3 District
The request is for a variance for a front yard setback of 31 ft. instead of the required 35 ft. in the R-3 Zoning District to provide a covered entry into the front of the house.

Michelle Marshall said they would like to add a small porch to the front entry of the home to provide both protection from the elements and improve the visual appearance of the property. Michelle Marshall said they have made improvements inside the home and would like to do the same outside. She said they thought a 6 ft. by 7 ft. structure would be enough to accommodate the overhang and swing the door out allowing for a couple people to stand in the area.

Dale VanLerberghe asked Michelle Marshall if she had a picture or architect’s drawing. Michelle Marshall said she did not have any drawings however she described a house nearby with a covered porch and pillars as similar to what they intended to construct. Dale VanLerberghe clarified the structure would be open with two posts. Sandy Erwin asked if there would be steps up to the porch. Michelle Marshall noted just flagstone and one step up to the floor of the porch with no other steps.

Jack DeVore made a motion to approve Case #543445 as presented. Sandy Erwin seconded the motion. Sandy Erwin, yes; Jack DeVore, yes; and Dale VanLerberghe, yes. Case #543408 is approved.

CASE #543446 – Mark and Joyce Waltz – 1432 Orchard Beach Dr. – R-3 District
The request is for a variance for a front yard setback of 6.5 ft. from the right of way to build a deck. There was no correspondence and no one present to speak on behalf of the request.

Jack DeVore voiced a concern that the lot description says 62 ft. but the figures given on the request add up to 64.5 ft. across. The other concern he had was looking from south to north the deck would protrude out quite a bit if they should enclose the deck. The road has a bend and Jack DeVore thought it could leave a blind spot.

After some discussion Sandra Erwin made a motion to approve request #543446 with the stipulation the deck would not be enclosed now or in the future. Jack DeVore seconded the motion. Sandra Erwin, yes; Jack DeVore, no; Dale VanLerberghe, yes. The request is approved two to one.

CASE #543452 – Andrew and Susan Passen – 3552 N. Southway – R-1 District
The request is for an area variance for a front yard setback of 29 ft. instead of the required
40 ft. for an addition. Lee Short spoke on behalf of the proposed project which is a 12’ x 19’ addition to the front of the existing house. The stone, glass and cedar addition would be enclosed living space. The four neighbors have been notified and have approved the project.
The existing 8 .4 ft. porch would be removed and the 12’x 19’ addition would be added in its place. The addition will add curb appeal to the property.

Jack DeVore made a motion to approve request #543452. Sandra Erwin seconded the motion. Sandra Erwin, yes; Jack DeVore, yes; Dale VanLerberghe, yes. Case #543452 is approved.

Jack DeVore made a motion to approve the minutes as presented from the June 10 Board of Zoning Appeals meeting. Sandy Erwin seconded the motion. Jack DeVore, yes; Sandy Erwin, yes; and Dale VanLerberghe, yes.

Sandy Erwin made a motion to adjourn the meeting and Jack DeVore seconded the motion. Motion carried unanimously. Meeting adjourned.
