Public Hearing

October 25, 2022

Trustee Matt Montowski called the Public Hearing to order on Tuesday, October 25, at 5:30 p.m. in the conference room of the administration building located at 4822 E. Cemetery Road.

In attendance were: Diane Belden, Matt Montowski, William Rofkar, Karen Shaw, John Gangway,
Todd Finke, Lindi Finke, Quintin Smith, Donna Smith, and Randy Riedmaier

Matt Montowski introduced application #157858 submitted by Quinmon, LLC & Quinstock Farms
to rezone Lot 2 of L.C. Heights Allotment number 2 (excluding the north 10 feet) to “C-1” Neighborhood Commercial District and Lots 3, 5, 6 of L.C. Heights Allotment and Lot 3 of L.C. Heights Allotment number 2 to the “C-2” General Commercial District.

Matt Montowski said the Ottawa Regional Planning Commission met on August 16, 2022 to review the request.

The lots abut the Gideon Owen Restaurant and are currently vacant. The adjoining parcels to the west are a restaurant owned by the applicant that is zoned “C-2” General Commercial, vacant ground “R-E” Residential Estate, and a single family home zoned “R-1” Residential. To the east is an accessory building and lots owned by the applicant which are zoned “C-1” Neighborhood Commercial. The properties to the north are vacant lots owned by the applicant and are zoned “R-E Residential Estate. To the south is the Gideon Owen Restaurant, a parking lot, and vacant ground zoned “C-2” General Commercial, “R-1” Residential and “R-E” Residential Estate, all owned by the applicant. The applicant would like to add additional parking as well as expand restaurant activities on the site.

The current Land Use Plan calls for commercial rezoning cases to be looked at on a case by case basis. The Land Use Plan states that the committee felt there may be a desire to include small commercial parcels as part of a larger residential development and/or to have smaller commercial properties subordinate to larger parcels. As such they did not call out certain areas of the township to consider commercial activities but rather to look at each case individually.

Matt Montowski said the Ottawa Regional Planning Commission voted to recommend approval of the rezoning request based on the Land Use Plan, as well as the surrounding land use and zoning of the adjacent parcels. He said the Catawba Island Zoning Commission met on September 28, 2022 to review the request and also voted to recommend approval.

Quintin Smith showed Trustees the requested changes on a map.

Todd Finke asked for confirmation that nothing would be put up within 60 feet of his property line.

William Rofkar said they can modify the request to keep 50 feet zoned “R-E” Residential Estate.

William Rofkar made a motion to approve the request for Lots 3, 5, and 6 of L.C. Heights Allotment from the “R-E” Residential Estate District to the “C-2” General Commercial District and Lot 3 of L.C. Heights Allotment 2 from the “R-1” Residential District and the “R-E” Residential


Estate District to the “C-2” General Commercial District and to modify the request for Lot 2 of the L.C. Heights Allotment 2 from the “R-E” Residential Estate District and the “R-1” Residential District to the “C-1” Neighborhood Commercial District except for 50 feet running north and south along the edge of the Finke property which will remain “R-E” Residential Estate. The rest of the parcel will be zoned “C-1” Neighborhood Commercial District as requested leaving 50 feet of the western edge of the lot zoned “R-E” Residential Estate (parcel 0131483220211002). Diane Belden seconded the motion. All voted aye. Motion carried.

Diane Belden made a motion to adjourn the meeting. William Rofkar seconded the motion. All voted aye. The meeting adjourned at 6:00 p.m.
