Meeting Minutes

May 14, 2019

The regular business meeting of the Catawba Island Board of Township Trustees was called to order by Chairman William Rofkar on Tuesday, May 14, at 7:30 p.m. in the conference room.

In attendance were: Gary Mortus, Matt Montowski, William Rofkar, Karen Shaw, Dan Barlow, John Gangway, Ernest Wylie, Kevin Wylie, William Moore, Jr., Julie Wylie, Kathryn Orovets,
Ryan Magrum, Sandy McLean, Randy Riedmaier, and Jack DeVore.

The Pledge of Allegiance was recited by all.

Matt Montowski made a motion to approve the April 23, 2019 Board of Trustees regular meeting minutes and the April 23, 2019 Special Meeting minutes as presented. Gary Mortus seconded the motion. All voted aye. Motion carried.

Gary Mortus made a motion to approve and pay the bills, including the last two payrolls, in the amount of $79,121.07. The total includes a payment of $6,240 to Masonry Construction for installation of the shuffleboard courts at Heigel Park and a payment of $9,617 to Republic Services for the spring clean-up. Matt Montowski seconded the motion. All voted aye. Motion carried.

Correspondence

A letter from Tom Letterhos requesting use of the Community Hall on September 27 for a family gathering.

Trustees agreed Tom Letterhos could use the Community Hall and waived the rental fee.

A letter from Resurrection Lutheran Church announcing the completion of a recent addition and remodel building project completed in December 2018 and an invitation to the Grand Opening on Sunday, June 9.

A letter from the Ottawa County Board of Commissioners and the Ottawa County Annual Report for 2018.

A letter from the Ohio Utilities Protection Service regarding recent changes to the O.U.P.S. General Operating Procedures approved during a special meeting held on April 18.

A letter from the Ohio Division of Liquor Control regarding ownership at Midway Marina Inc.

Gary Mortus made a motion to not request a hearing regarding the Midway Marina permit.
Matt Montowski seconded the motion. All voted aye. Motion carried.

Fiscal

Fiscal Officer Karen Shaw presented the April 2019 financial reports and bank reconciliation. There were no questions or concerns.

Zoning

Matt Montowski recused himself prior to the zoning public hearing.

William Rofkar said zoning application #331853 initiated by John and Kathryn Orovets and requesting to rezone a parcel of land from “A” Residential Low Density to “R-1” Residential was reviewed and heard by the Ottawa Regional Planning Commission on April 16, 2019. The Commission considered the following: The applicant is requesting to rezone approximately 10.296 acres in Catawba Island Township located at 2320 N.W. Catawba Road. The parcel currently contains a single family home and the owner would like to sell the land behind the home for residential development. The adjoining parcels located to the south are single family homes in a subdivision and are zoned “R-1” Residential. The parcels located to the north and west are a residential development containing condos and they are zoned “R-5” Residential. The parcel to the east across the street is zoned “R-E” Residential Estate and is part of the CIC Golf Course. The current land use plan calls for medium density residential in this area of Catawba Island and as such the request would meet the current Land Use Plan.

William Rofkar said the Ottawa Regional Planning Commission voted to recommend approval of the rezoning request based on the Catawba Island Land Use Plan.

William Rofkar opened the floor for discussion.

Kathryn Orovets said she has lived there for 40 years and would like the property zoned residential for the future because it is located between two residential areas and is no longer used for agricultural purposes although it was once a farm and peach orchard. Kathryn said she is not sure if she will develop the land or not but would like it to be zoned residential.

Two adjoining property owners were present and one asked what kind of development would be allowed in the future. William Rofkar said the R-1 district has constraints for single family housing and lot size is dictated in the Zoning Resolution

William Rofkar said the Catawba Island Zoning Commission met on April 24 and recommended approval of the request.

Gary Mortus made a motion to approve zoning application #331853 as requested and recommended by the Ottawa County Regional Planning Commission and the Catawba Island Zoning Commission. William Rofkar seconded the motion. Vote on the motion: Gary Mortus, aye; William Rofkar, aye. Motion carried.

William Rofkar closed the Zoning Hearing and Matt Montowski returned to the meeting.

Matt Montowski said there were 16 zoning permits, two conditional uses and one variance issued in April with a total of $1,676.20 collected in fees.

Matt Montowski made a motion to appoint Brian Caldwell as an alternate on the Board of Zoning Appeals for a one year term. Gary Mortus seconded the motion. All voted aye. Motion carried.

Matt Montowski made a motion to appoint Jeff Green as an alternate on the Zoning Commission Board for a one year term. Gary Mortus seconded the motion. All voted aye. Motion carried.


Maintenance

Maintenance Supervisor Dan Barlow said the grant offered by the OSS Solid Waste District for picnic tables made of recycled material was not as much as requested and they are not offering additional grants the rest of the year. Dan Barlow said picnic table frames can be purchased from Gerber Tables and maintenance personnel can assemble. He presented a quote for $2,564 for ten galvanized table frames, one accessible table with single overhang, and two tot tables.

Matt Montowski made a motion to purchase picnic table frames from Gerber Tables LLC out of Madison, Wisconsin for $2,564. The township will purchase the wood separately and assemble the tables for use at Heigel Park. Gary Mortus seconded the motion. All voted aye. Motion carried.

Dan Barlow presented two quotes for grinding material at the compost facility; Barnes $19,700 and Lake Erie Tree Service $11,000. Grinding material will remain on site. Dan Barlow said Universal Farms declined to bid due to being unable to meet the start date required.

Gary Mortus made a motion to approve a contract with Lake Erie Tree Service for grinding material at the compost facility for $11,000. Matt Montowski seconded the motion. All voted aye. Motion carried.

Dan Barlow presented a drawing and quote for $2,295 from Davenport Sign & Art for new 12 inch letters for a sign at the Community Hall and address numbers for over the door.

Gary Mortus made a motion to contract with Davenport Sign & Art for installation of signage at the Community Hall for $2,295. Matt Montowski seconded the motion. All voted aye. Motion carried.

Dan Barlow presented a quote from Pavement Technology, Inc. for $36,343.80 to apply Reclamite asphalt rejuvenator to the township parking lot and the following township roads: Woodland, Schoolhouse, Valley, Twin Beach, Weyhe, and Wine Cellar.

Trustees said representatives gave a presentation of the product at the Ottawa County Township Association meeting in April hosted by the Ottawa County Engineers Office and it was impressive. Gary Mortus said the product adds life to newer pavement and that it would not be applied to older pavement. He said the state, the county, and many other townships use the product. Gary Mortus said that he and Dan Barlow recently met with representatives and reviewed township roads.

Gary Mortus made a motion to approve a contract for $36,343.80 with Pavement Technology, Inc. out of Westlake to apply Reclamite asphalt rejuvenator per provided proposal. Matt Montowski seconded the motion. All voted aye. Motion carried.

Dan Barlow said the shuffleboard courts at Heigel Park will be ready to use after sealer is applied.

Dan Barlow presented a quote for $17,853 from JVS Garage Door to install a security gate at the entrance to the township compost facility. He said the gate is necessary to keep commercial vehicles and others from outside the township from hauling material into the facility. It is possible the township could start charging non-residents and contractors for dropping material at the facility as it poses an added expense to grind the material on a regular basis.

Gary Mortus made a motion to approve a contract for $17,853 with JVS Garage Door to install a security gate at the compost facility and not to exceed $19,000 total including the additional electrical work contract. Matt Montowski seconded the motion. All voted aye. Motion carried.

Police

Police Chief John Gangway said Devin Pollock is required every two years to attend a Taser Instructor recertification class. He said the two day class is offered in Cleveland for $495. He said Devin Pollock does a nice job with training in-house and also for some other area agencies.

Trustees agreed Devin Pollock should attend the necessary Taser Instructor recertification class.

Fire

Fire Chief Kevin Wylie reported there were four fire runs and 23 EMS runs for the month of April.

Matt Montowski made a motion to enter into a Client Services Agreement with Medicount Management Inc. for EMS billing services for a three-year contract with a base rate fee of 7.5% of the gross amount collected. Gary Mortus seconded the motion. All voted aye. Motion carried.

New Business

A brief discussion took place regarding grass clippings being blown into the street creating a safety concern for motorcyclist and bikers.

Gary Mortus said a resident from Eagle Beach has inquired about the possibility of putting a crosswalk across Sand Road. He said the Ottawa County Engineer has advised against crosswalks due to the liability and for that same reason there is not a crosswalk located on Wine Cellar Road or at the Community Hall.

Gary Mortus made a motion to enter into a Memorandum of Understanding between the Catawba Island Township Trustees and the Ottawa County Engineer and approved by the Ottawa County Commissioners with the purpose that the Trustees and Engineer have the common objective of cooperatively maintaining West Catawba Road. The Trustees shall perform all snow and ice removal on West Catawba Road in the same manner they do for all other township roads and the Engineer will be responsible for all other roadway maintenance such as patching, crack-sealing, resurfacing, drainage issues, and reconstruction. The Engineer will pay 75% of the salt used by the township for ice control during the winter season and the rate may be adjusted annually by mutual agreement. The agreement may be amended or terminated at any time by mutual consent or may be terminated by either party by giving (90) days’ notice in writing to the other. Matt Montowski seconded the motion. All voted aye. Motion carried.
