Meeting Minutes

March 24, 2020

The regular business meeting of the Catawba Island Board of Township Trustees was called to order by Chairman Matt Montowski on Tuesday, March 24, at 7:30 p.m. in the conference room.

In attendance were: Diane Belden, Matt Montowski, William Rofkar, Karen Shaw, John Gangway, Andrea Kummero, and Randy Riedmaier.

The Pledge of Allegiance was recited by all.

William Rofkar made a motion to approve the March 10, 2020 Board of Trustees regular meeting minutes as presented. Diane Belden seconded the motion. All voted aye. Motion carried.

Diane Belden made a motion to approve and pay the bills, including the last payroll, in the amount of $78,262.87. William Rofkar seconded the motion. All voted aye. Motion carried.

Correspondence

A notice from the Department of Commerce Division of Liquor Control that all permits to sell alcoholic beverages in the township will expire on June 1, 2020 and that permit holders must file a renewal application. Ohio Revised Code provides the legislative authority with the right to object to the renewal of a permit and to request a hearing.

A letter from Ohio Auditor of State Keith Faber regarding the increased cost of basic financial audits and the creation of a Local Government Audit Support Fund (LGASF) to be included in the most recent state operating budget.

A letter from Anthem & SOCA Benefit Plan regarding the 2020 renewal package.

A note of appreciation from Frank Harmon of Ohio Insurance Services and offer of support.

A letter from O.E. Meyer Co. regarding equipment decontamination communications being provided to medical gas customers.

An invitation from Lake Erie Shores & Islands to the State of Tourism Address on April 30.

Fiscal

Karen Shaw said the township received the first half Real Estate Property Tax Settlement in March with a net distribution of $879,890.61.

Police

Police Chief John Gangway said the owners of Gem Beach donated N95 masks to both the police department and the fire department.

John Gangway said the rifles have been delivered and will be in service in the near future.

New Business

Andrea Kummero expressed her concern regarding comments made at the Board of Zoning Appeals meeting held on March 11. Andrea Kummero said she wanted to defend her name in the matter.

Matt Montowski said he did not feel there was any ill will toward her but the conversation needed to be continued with the Board of Zoning Appeals and not with the Board of Trustees at this time.

William Rofkar made a motion to participate in the Ottawa County Engineer’s Road Striping Program for 2020 and stripe the roads as listed below. Diane Belden seconded the motion. All voted aye. Motion Carried.

William Rofkar made a motion to pass a resolution to participate in the Ohio Department of Transportation’s Road Salt Contracts Awarded in 2020 and request 250 tons of salt.
Diane Belden seconded the motion. All voted aye. Motion carried.

William Rofkar presented a policy for adoption with guidance from Ottawa County Prosecutor James VanEerten. The Paid Administrative Leave policy presented states in part:

Designated non-essential full-time personnel of Catawba Island Township maintenance department are hereby placed on Paid Administrative Leave effective 12:00 a.m. March 24, 2020. This leave will continue until 11:59 p.m. April 6, 2020, or until modified by the Catawba Island Board of Trustees with guidance based on the stay-at-home order by the Ohio State Department of Health.

While on Paid Administrative Leave employees are subject to all policies and procedures as outlined in the Policies Manual. Special attention is requested to follow ten specified guidelines in regard to reporting to work when called for essential duties and failure to follow the guidelines and policies established by the Trustees during Paid Administrative Leave are grounds for disciplinary action up to and including termination.

A lengthy discussion took place regarding the unique situation of a stay-at-home order and whether maintenance personnel and/or their duties are considered essential.

William Rofkar made a motion to adopt a resolution in regard to Ohio Revised Code 124.889 which provides for an Appointing Authority to place an employee on administrative leave with pay in circumstances where the health or safety of an employee or other person or property entrusted to the employee’s care may be adversely affected. Compensation for this leave with pay shall be equal to the employee’s base rate of pay. The length of this leave is at the discretion of the appointing authority but shall not exceed the length of the situation for which leave was granted. Thereby adopting the Paid Administrative Leave policy presented into the township manual.
Diane Belden seconded the motion. All voted aye. Motion carried.

William Rofkar said Patty Cable will continue to work in the office and answer the phone.

Matt Montowski said Zoning Inspector Todd Bickley will work from home and his township phone has been forwarded and he has access to his emails from home.

Matt Montowski said the Zoning Commission will not meet in April but the Board of Zoning Appeals plans to meet April 8 as scheduled.

William Rofkar said he felt the BZA meeting should be cancelled.

Matt Montowski said he would consult James VanEerten regarding the scheduled BZA meeting.

Diane Belden made a motion to cancel Spring Clean Up scheduled for April 15 through April 19 due to the stay-at-home order by the Ohio State Department of Health. William Rofkar seconded the motion. All voted aye. Motion carried.



William Rofkar made a motion to contract with Pavement Technology, Inc. to apply Reclamite asphalt rejuvenator to Konker Road, Peachton Drive, Hickory Ridge Drive and N. Hanne Street for $20,538.08. Diane Belden seconded the motion. All voted aye. Motion carried.

William Rofkar made a motion to purchase a John Deere 12” Bucket for the backhoe from Murphy Tractor & Equipment for $1,000. Diane Belden seconded the motion. All voted aye. Motion carried.

Trustees agreed the Administration Building and the Community Hall will be closed to the public during the stay-at-home order.

Matt Montowski said on March 12 he attended the Ottawa County District Advisory Council for the Ottawa County Health Department Board. Matt Montowski also shared the Annual Report of the Ottawa County Health Department and reported there were 967 activities recorded by the Health Department for Catawba Island Township in 2019.

Diane Belden made a motion to adjourn the meeting. William Rofkar seconded the motion.
All voted aye. The meeting adjourned at 9:08 p.m.
