Chairperson Davenport called the meeting of the Catawba Island Township Zoning Commission to order at 7:00 p.m. For the record, he identified the date as August 26, 2026.
The room was asked to stand for the pledge of allegiance.
The meeting then moved to the agenda provided by Chairman Davenport.
Agenda Item 1 – New Application to the Commission
Case #: 233070 Nor Easter PUD
Chairman Davenport provided the case overview involving eight single family homes in an RE zoning. Chairman Davenport asked a question if this is a new PUD or amending the existing PUD from 2008. Peter Segaard, project engineer with DGL Consultants, indicated this is an amendment to the existing (2008) PUD. Chairman Davenport asked what happens to the existing 8 condominiums (Nor Easter Cove) from the 2008 PUD. Applicant’s attorney Gabby Toscano indicated that the 2008 PUD included the eight (8) Nor Easter Cove Condominium (hence forth referred to as “the condos”), two additional condos (not built) and the NE Club and pool (now razed/removed). Ms. Toscano indicated in a May 2026 meeting with Todd Bickley who indicated that the new plan is not a minor revision and thus could not be managed administratively and needed to go through the PUD process. She also explained the water-slip condominium process where a person purchases the dock and would have a common element (land). The intent is to have a permanent exclusive easement on the land (lots) to build a home for each dock purchase. Each water-slip owner would have to get a Zoning Permit to build the house. Ms. Toscano indicated that the housing density is within code for the RE Zoning. The association will maintain the common space and also provide the architectural review of the homes.
Chairman Davenport asked for understanding on how the 8 condos have been split from the 2008 PUD with the current PUD plan is based on ~5 acres and, whereas, the 2008 PUD was ~11 acres (which included a road and common grounds). He asked Ms. Toscano if the first PUD (2008) was dissolved. Ms. Toscano indicated to the 2008 PUD was not dissolved and this submittal is intended to be a modification of the 2008 PUD.
Chairman Davenport indicated if the eight (8) condos (Nor Easter Cove) are still in the PUD then the land calculations do not reflect the 11 acres in the 2026 PUD. Chairman Davenport also asked if the PUD applicant owns the 8 condos in which Ms. Toscano indicated Mr. Crawford does not. Mr. Crawford confirmed that he bought the ~5 acres, not the condos and then sold the seawall jetty dockage east of the condos to the condos. It was asked if two different owners can own separate properties within the same PUD.
Mr. Brian Snyder asked who owned the road. Chairman indicated the 2008 PUD had the road in the PUD. Mr. Al Fotheringham from the condos and HOA president indicated that by their HOA by-laws they do have ownership of the road.
Chairman Davenport indicated by our code that this plan is not a minor modification of the 2008 PUD. A modification that is not minor must be put through PUD process including a public meeting and Trustee approval. Furthermore, the 8 condos currently have rights to the common space of the ~11 acres PUD.
Ms. Toscano presented the 2008 PUD plan for the 11 acre site and discussed the common grounds. Chairman Davenport pointed out the 2008 open area that belong to all residents of the PUD including the 8 condos and while the area is zoned RE it is encompassed in the PUD. Chairman Davenport asked Ms. Hartline to present the 2008 PUD plan documents from 2008.
Chairman Davenport indicated that to separate the eight (8) existing condos requires that there is a legal document to prove the eight (8) existing condos have been split and would no longer have access to the common grounds of the new 2026 PUD. Discussion included having the 8 condo owners provide some sort of legal document withdrawing from the PUD. Ms. Toscano said they are not out of the PUD. The issue of whether the new PUD can be separated from the other portion of the 2008 PUD (that has the 8 existing condos).
Chairman Davenport indicated that if we are amending the 2008 PUD, then it seems the full 11 acres needs to be amended in the amended 2026 PUD. Zoning classification (RE) was discussed.
It was also discussed by Mr. Fotheringham that they never had access to the NE Club of the 2008 PUD (as the club was member based).
Chairman Davenport indicated the course of action needs to be:
1. Either the plan needs to include the entire ~11 acres as an amended 2008 PUD, or
2. Present a new ~5 acre PUD and provide the legal documents that separates the 8 existing condos from this 2026 PUD.
Chairman Davenport indicated that the 2026 PUD is a modification or a new PUD needs to be clarified, as the plan sites it cannot be approved as we have 2 PUDs on the same property.
Ms. Hartline offered that the road (Nor Easter Cove Street) is entirely within the Nor Easter Cove condo property limits.
Ms. Toscano indicated that there is a plat that separates the 8 condos in her office and there can be 2 owners in the entire 11 acres. Ms. Toscano asked if there is anything in the 2008 PUD that shows the 8 condos have access to areas in the all 11 acres of the 2008 PUD. Chairman Davenport reviewed the 2008 plan that presents the open space that the 8 condos have rights to.
A motion was made by Mr. Shaw to postpone the case to the next month (September 23, 2026) to allow for resolution of the PUD questions and was seconded by Dr. Hart. A unanimous vote was made to postpone until next month.
