Trustee Matt Montowski called the public hearing to order at 6:00 p.m. Trustee Montowski introduced Trustee Diane Belden and Zoning Inspector Todd Bickley.
Trustee Montowski noted that the purpose of the public hearing is to consider Case #737674, which consisted of a rezoning application by Jon Kriegel to rezone a parcel of land from the “R-1” to the “R-3” Residential Zoning District. The parcel of land is in Lot 5, Section 3 of Catawba Island Township and is known as Parcel #0130259014662000. The parcel contains 21.9 acres of land. Trustee Montowski reviewed the legal notice.
Neither Trustee in attendance had a conflict of interest and Trustee Montowski noted that Trustee William Rofkar was not in attendance due to a conflict.
Trustee Montowski and Mr. Bickley reviewed the parcel’s zoning history.
Trustee Montowski read correspondence from the following individuals: Cathy & Tony Kegley, Robert J. Cachat, Charlie & Linda Knotek, Marylue & John Carroll, Michael O’Donnell, Rita & Bob Hathaway, and Lisa Decker.
Trustee Montowski read the letters of recommendation from the Ottawa Regional Planning Commission and the Catawba Island Zoning Commission.
Trustee Montowski recognized Daryl Roston. Mr. Roston expressed concern with the land previously being used as an orchard and the possible pesticide levels. Mr. Roston commented that testing needs to be done, which would determine possible hot spots. Mr. Roston was also concerned with flooding after the land has been turned over and the contaminates would be flushed out and run to adjacent properties. Trustee Montowski noted that drainage would be reviewed by the Ottawa County Engineer when a subdivision is submitted to the Ottawa Regional Planning Commission.
Trustee Montowski recognized John Young who expressed concern with infrastructure problems.
Trustee Montowski recognized Carol Clemons who commented that a record of the contamination must be filed somewhere.
Todd Bickley responded to several questions concerning the rezoning process, subdivision process including plan requirements and road maintenance, and possible agencies with review requirements.
Trustee Montowski recognized Judy Geiger who questioned the lot size differences. Mr. Bickley explained the differences between the two (2) districts and Ms. Gieger commented that the larger lot would attract families.
Trustee Montowski recognized Brendan O’Malley who noted that the rezoning application does not adhere to the land use plan, the applicant has not developed a plan, and the applicant has had a second opportunity to address the application with the neighborhood, but he has not shown up.
Trustee Montowski recognized Glen Vargas who questioned the road easement and who controls it. Mr. Bickley explained the street dedication and the possible responsibility of the road easement and any new roads.
Trustee Montowski recognized Christina George and Ms. George expressed concern for wildlife.
Trustee Montowski closed the discussion from the floor.
Trustee Diane Belden made a motion to deny the rezoning application (Case #737674) from the “R-1” Residential District to the “R-3” Residential District for Parcel #0130259014662000. The motion was seconded by Trustee Matt Montowski. Motion passed with both trustees voting in the affirmative.
Trustee Diane Belden made a motion for adjournment. The motion was seconded by Trustee Matt Montowski and the motion passed. The hearing was adjourned at 7:05 p.m.
