Chairman Bryan Baugh called the meeting to order at 7:00 p.m. The Pledge of Allegiance was recited. Board members in attendance included: Sandy Erwin, Jack Zeigler, Doug Blackburn Alternate Flint Heidlebaugh and Todd Bickley, Zoning Inspector. Chairman Baugh read through the meeting process. He asked if there were any questions concerning the procedure to be used. There were none.
New Business
Case #068140 – Robert & Rita Maschmeier
Secretary Sandra Erwin read the facts of the case. The applicants own property at 5365 E. Port Drive, also known as Lots 134 & 135 of Plat B of Johnson Landing’s Subdivision. The property is located in the “R-3” Residential District and the applicants are proposing an addition to an existing single family dwelling and they are requesting a variance to reduce the side yard setback from ten feet (10’) to five feet (5’).
No board member had a conflict.
Robert Maschmeier was sworn in by Chairman Baugh. Mr. Maschmeier proposes an addition to an existing cottage and he would like to maintain the existing five (5) foot setback. The ten (10) foot setback would be difficult to meet. Mr. Maschmeier noted that the cottage was built in 1940 an it needs to be updated. The variance would be for the west side of the property.
Todd Bickley explained that Mr. Maschmeier has combined Lots 134 & 135 of Johnson Landing’s Subdivision for zoning purposes and as a result, the side yard setback increases from five feet (5’) to ten feet (10’) based on lot width.
Chairman Baugh questioned if the applicant would prefer to tear down the cottage. Mr. Maschmeier commented that would be his preference, but was not sure if the BZA would support a variance for a new structure.
There being no additional questions, discussion was closed to the floor.
The Board reviewed the Finding of Fact. The Board disagreed with the applicant by a 3 – 2 vote on Item 1; agreed with the applicant on Items 2, 3, 4, 5 and 7 by a 5 – 0 vote ; and disagreed with applicant on Item 6 by a 4 – 1 vote.
Sandra Erwin made a motion to amend Case #068140 so that the cottage would be demolished rather than expanded and approve amended Case #068140 that the west side yard setback for the new home be reduced from ten feet (10’) to five feet (5’). The motion was seconded by Flint Heidlebaugh. Motion passed.
Case #068152 – D. Scott Emond
Secretary Sandra Erwin read the facts of the case. The applicant is proposing an attached garage to a single family home located at 1590 N. Starboard Road and also known as Lot 121 of Harbor Park Marina Subdivision. The applicant is requesting a variance to reduce the rear yard setback from thirty-five feet (35’) to six feet (6’).
No board member had a conflict.
Charlie Johnson, representing the applicant, was sworn in by Chairman Baugh. Mr. Johnson indicated that the applicant would like a garage to park his car. The garage location would be similar to other garages in the area.
Chairman Baugh questioned if the approval has been obtained from the Harbor Park Association. Mr. Johnson indicated that it was approved when the house was originally approved. The applicant is now proposing to build the structure. Mr. Johnson indicated that the garage will have a 7 to 12 pitch so that it conforms with the existing home.
There being no additional questions, discussion was closed to the floor.

Doug Blackburn made a motion to approve Case #068152. The motion was seconded by Jack Zeigler. The motion passed.
Other Business
Parking Area Fence – South Passage
Mr. Bickley explained that Miller Boat Line has acquired the Beach Cliff Lodge property and intends to use it as a parking area. Item C2 of Section 5 states that when a lot adjoins an “A” or “R” District, the erection of a fence is to be approved by the Board of Zoning Appeals. The applicant proposes a chain link fence with a gate along NE Catawba Avenue, which is located across the street from property in the “A” District.
Doug Blackburn made a motion to accept the chain link fence as proposed by South Passage. The motion was seconded by Jack Zeigler. Motion passed. Sandra Erwin abstained.
Miller Boat Line Parking Area – Jeff Jadwisiak
Jeff Jadwisiak reviewed the decision to approve the use variance submitted by JBS Market (Miller Boat Line) for property located at 5358 Porter Street. Mr. Jadwisiak reviewed the finding of fact criteria.
Approval of Minutes – May 9, 2018
The meeting minutes from the May 9, 2018 meeting was mailed to each member. Doug Blackburn moved to approve the May 9, 2018 meeting minutes. Flint Heidlebaugh seconded the motion. Motion passed.
Adjournment
Sandra Erwin moved to adjourn the meeting. The motion was seconded by Doug Blackburn. The meeting was adjourned at 7:57 p.m.
